General Terms and Conditions of Sale


Effective date: 1 July 2024

1. Seller identity

The website www.my-headspa.com is published by BME Consulting EURL, a company with a share capital of 113,000 euros, registered at 113 Rue Marietton, 69009 Lyon, France.

SIREN: 754 058 410 — EU VAT number: FR24754058410.

2. Scope of application

These General Terms and Conditions of Sale ("T&Cs") apply to all sales of products and services concluded via www.my-headspa.com, as well as to the contractual relationship between BME Consulting and its professional or consumer customers.

Placing an order constitutes full and unconditional acceptance of these T&Cs.

3. Products and availability

Products are described and presented as accurately as possible.

Offers are valid while stocks last.

4. Prices

Prices are shown in euros, both excluding and including applicable taxes.

BME Consulting reserves the right to modify prices at any time. Products are invoiced at the price in effect at the time of ordering.

5. Orders

An order becomes firm and binding once confirmed by BME Consulting.

The customer undertakes to provide accurate information when placing an order.

6. Payment

Payment is due immediately upon ordering, unless otherwise agreed in writing.

In the event of deferred payment, any amount not settled by the due date will result in:

  • Late-payment penalties calculated at the statutory rate plus 10 percentage points,

  • A fixed debt-recovery indemnity of 40 euros (pursuant to Article L441-10 of the French Commercial Code).

7. Retention of title

Title to the goods remains with BME Consulting until full payment of the price has been received.

In the event of non-payment, BME Consulting reserves the right to reclaim the delivered products.

8. Delivery and transfer of risk

Delivery timeframes are indicative only.

BME Consulting shall not be held liable for any delay attributable to the carrier or the customer.

Risk passes to the customer upon handover of the goods to the carrier.

9. Conformity and warranties

  • All products benefit from the statutory warranty of conformity (Articles L217-3 et seq. of the French Consumer Code) and the statutory warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

  • Any applicable commercial warranty is specified on the invoice.

  • The customer must notify any non-conformity or apparent defect within 7 working days of delivery.

10. Returns and complaints

No goods may be returned without prior written authorisation from BME Consulting.

Return shipping costs are borne by the customer, except in the event of proven non-conformity.

11. Liability

BME Consulting shall not be held liable for any indirect loss arising from the use of the product.

Liability is in all cases limited to the value of the order.

12. Intellectual property

All elements of the website and documents provided are protected by copyright and remain the exclusive property of BME Consulting.

13. Personal data

BME Consulting processes its customers' personal data in compliance with the GDPR.

Each customer has the right to access, rectify, and delete their data by writing to: contact@my-headspa.com.

14. Force majeure

BME Consulting shall not be liable for any delay or failure to perform resulting from a force majeure event (strike, pandemic, natural disaster, customs blockage, etc.).

15. Governing law and jurisdiction

These T&Cs are governed by French law.

Any dispute shall be subject to the exclusive jurisdiction of the Commercial Court of Lyon (Tribunal de commerce de Lyon).
